ORDER

1.      This revision petition is directed against the order of the State Commission dated 19-05-2014 whereby the said Commission allowed the application filed by four persons namely Rajinder Prasad, Deepak Kumar, Kapil Kumar and Fakir Chand for condonation of delay of 209 days in filing the appeal against the order of the District Forum dated   07-11-2012. The delay was condoned on the ground that the applicants came to know of the impugned order only when the applicant No.1, Rajinder Prasad Agnihotri received summons in a suit filed by respondents Nos.2 to 4 which included Narender Singh, complainant in the complaint filed before the District Forum. Considering the reasons given by the aforesaid applicants for condonation of delay we are not inclined to interfere with the order of the State Commission. We however, make it clear that while contesting the appeal it shall be open to the petitioner to take all such plea as are open to him in law, including that the appeal by the aforesaid applicants is not maintainable with or without prior permission of the State Commission considering that they were not parties to the complaint.

          The revision petition is accordingly dismissed.
