This a complaint filed under section 35 of the Consumer Protection Act, 2019 alleging deficiency of service on the part of the opposite party.
- Notice was issued by registered post from this Commission on 7/03/2023 and the same was received by the opposite party and postal acknowledgment card duly signed, received back. Vakkalath was filed for the opposite party on 4/04/2023. But the version was not filed within the prescribed time. It was filed only on 7/6/23 along with IA No. 218/2023. IA No. 218/2023 was dismissed as per order dated 13/11/2023 and the opposite party was set ex-parte.
- Today the case is posted for the affidavit of the complainant as last chance. But the complainant remained absent and there is no representation for him. The onus is on the complainant to prove the allegation of deficiency of service. But the complainant failed to let in any evidence to prove the case so as to get an order as prayed for. The complainant is continuously absent in spite of giving intimation and it appears that he is not interested in pursuing the matter. The allegations are not proved.
In the result, the complaint is dismissed. No order as to costs.
