The case of the complainant is as follows.
The complainant purchased a Television set in 2006 November. Television became dead on 15th December 2009. The complainant approached the 2nd opposite party and informed the matter. A technician from Customer care centre checked the Television set and took the circuit board to the care centre. The complainant was asked to come after a few days as spare parts was not available with the opposite party - 2 - An amount of Rs.680/- was paid. A technician accompanied the complainant to his house and fitted the circuit board. But the Television is not working. All these repeated several times. But of no use. The complainant was informed by the 2nd opposite party that the complainant has to spend Rs.1000/- more to repair the Television. So the complainant entrusted the Television with 2nd opposite party on 7th January 2010. Complainant filed this complaint to get back the Television and an amount of Rs.10,000/- as compensation and cost. The complaint was admitted. Opposite party was set ex-parte. Complainant filed affidavit and Exhibit A1 was marked.
The case of the complainant is that he paid Rs.680/- towards the repairing of the Television set. Exhibit A1 shows the same. The grievance of the complainant is that on the same day on which the repairing was effected, television was not working. The technician who accompanied the complainant fitted the repaired the circuit board to the television set, but it was not working. Opposite party demanded Rs.1,000/- more for effecting further repairs. We are of the view that collecting repair charges without actually effecting the repairing works is deficiency in service on the part of 2nd opposite party.
Thus we allow the complaint. We direct the opposite parties to pay jointly and severally an amount of Rs.1,000/- as compensation and Rs.500/- as cost of the proceedings. 2nd opposite party is directed to return back the Television and pay Rs.680/- which the complainant has already paid. Otherwise the complainant is entitled to get Rs.5000/- more from the opposite parties. Order to be complied within one month from the date of order failing which the whole amount shall carry interest at the rate of 9% per annum from the date of order till realization.
