View 1430 Cases Against Automobile
Harbir Automobile Pvt. Ltd. filed a consumer case on 13 Jun 2017 against Rajesh Kumar in the StateCommission Consumer Court. The case no is A/118/2017 and the judgment uploaded on 16 Jun 2017.
On 03.05.2017, the following order was passed by this Commission :-
“As per office report, record of the District Forum has been received.
At the time of hearing, Counsel for the appellant confined his prayer only qua grant of compensation and litigation expenses, stating that awarded amount is on the higher side. He further states that as per facts, some amount is also due to be recovered from respondent No.1/complainant.
Notice of motion limited to that extent only be issued to the respondents for 13.06.2017.
Alongwith the appeal, an application for condonation of delay of 19 days as per the applicant/appellant (as per the office report 22 days), in filing the appeal, has been filed.
Let notice of this application be also issued to the respondents for the date fixed.
Party outside the tricity be served through registered A.D. Cover.
Dasti notice be also given to the Counsel for the appellant for the service of the respondents situated within tricity.”
In response to notice issued, Sh. N.S.Jagdeva, Advocate has put in appearance on behalf of respondent No.1 and filed his memorandum of appearance, which is taken on record. Similarly Sh. Subhash Chand, Advocate has put in appearance on behalf of respondent No.2 and filed his Vakalatnama, which is taken on record.
Alongwith the appeal, an application for condonation of delay of 19 days as per the applicant/appellant (as per the office report 22 days), in filing the appeal, has been filed.
Heard.
For the reasons stated in the application, which is supported by a duly sworn affidavit and finding sufficient cause, the delay aforesaid is condoned.
The application is disposed of accordingly.
Sh. N.S.Jagdeva, Advocate, Counsel for respondent No.1 very graciously stated that let the compensation and litigation expenses awarded vide order dated 01.03.2017 by District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short “the Forum” only) in Consumer Complaint No.224 of 2016 be reduced.
In view of above statement, we reduce the compensation awarded by the Forum from Rs.5,000/- to Rs.3,000/- and litigation expenses from Rs.5,000/- to Rs.3,000/-.
In terms of order passed, this appeal stands disposed of and judgment passed by the Forum is varied to that extent.
Certified copies of this order be sent to the parties, free of charge.
