Again complainant has not appeared before this Commission, despite having called the case several times since morning up to 2.10PM. Further wait is unjustified. This Commission proceed ahead.
The complainant purchased electric scooter from the opponent No.1, being manufacturer of opponent No.2, fact is reflected from invoice Ex.C.4. He aggrieved from defect in the scooter filed complaint against the opponent, leveling allegations of deficiency in service, manufacturing defect in the scooter. He has shown address of opponent No.2, Khasra No.144/5/2, Rohad Industrial Area, Bahadurgarh, Haryana. In case process is issued against the opponent No.2, as per address disclosed, it will not served any purpose, because Process Server or the Postman as the case may, be could not trace out Khasra number of land. It is function of the Revenue Authority and even the Patwari may not able to find Khasra number, due to construction. During the pendency of the complaint, the complainant was orally advised to correct the address of the opponent No.2, but inspite of doing the needful, the complainant failed to appear before this Commission, on 24.4.2024 as well as on today. Mentioning of address of the opponent No.2, showing Khasra Number is patent defect in the complaint. The complaint is hereby ordered to be rejected. However, the complainant is at liberty, after correction of the address of the opponent No.2, such as disclosing the plot number, lane number, the complainant shall be at liberty to file a fresh complaint against the opponents, disclosing the particulars of this complaint and its fate, as already observed on 2.4.2024, 24.4.2024. The complainant is not entitled to the benefit of notice to the opponent, after expiry of period of 21 days from the date of receipt of complaint before this Commission. Original documents of Ex.C.2, Ex.C.3 and Ex.C.4 are hereby ordered to be returned to the complainant or his counsel against proper receipt.
Certified copy of this order be supplied to the parties concerned free of costs.
File be consigned to the records.
