Final Order / Judgement

As per office report, the record of the District Forum has been received.

Alongwith the appeal, an application for condonation of delay of 6 months 28 days as per the applicant/appellant  (as per the office report 206 days), in filing the appeal, has been filed.

Let notice of the application for condonation of delay, as also of the main appeal be issued to respondent No.1/complainant only.

At this stage, Sh. N. S. Jagdeva, Advocate, who was representing the complainant before the Forum, puts in appearance and accepts notice on behalf of respondent No.1/complainant. Copy of complete paper-book has been supplied to him.

Counsel for the parties states that they are ready to address arguments.

We have heard the Counsel for both the parties.

When we showed our inclination to dismiss the application for condonation of delay and also the appeal on merits, Counsel for the appellant states that he is ready to settle the matter amicably.

Counsel for respondent No.1/complainant, when confronted by us that the compensation awarded is on the higher side, he states that let reasonable compensation be awarded.

After hearing Counsel for both the parties, we order that let the matter be finally settled for an amount of Rs.50,000/- towards settlement of all claims between the parties, which respondent No.1/complainant has agreed to pay to the appellant on the next date of hearing before the Forum through a bank draft/cheque.

In view of above settlement, the appeal stands disposed of.

Certified copies of the order be sent to the parties free of charge.
