JUDGMENT
JUSTICE SHRI. P.Q. BARKATH ALI : PRESIDENT
This is a complaint filed by parents of deceased Shanib. A.P. who died out of complications which arose out of a surgery conducted by the opposite party’s hospital. Complainant claimed a compensation of Rs.40,00,000/- alleging negligence against the opposite parties.
2. The 1st opposite party is Rajendra Nursing Home, Kozhikode and the opposite parties 2 to 7 are Medical Officers therein. They filed IA 1532/15 challenging the maintainability of the complaint, on the ground the matter has been filly and finally settled between the parties and Rs.10,00,000/-has been paid to the 1st complainant.
3. On going through the copy of the agreement dated January, 10, 2013, between the 1st complainant and the opposite parties, it is seen that Rs.4,17,302/- was paid by the opposite parties for the treatment expenses of the patient and Rs.1,82,698/- is paid towards amounts spent in the Vellore hospital and in addition to that Rs.4,00,000/- was paid to the 1st complainant. On going through the agreement it clearly shows that it is a fully and final settlement of the claim. The National Commission in Worldwide Immigration Consultancy Services Ltd. & Ors. Vs. Gangadeep Singh Monga 2015(2) CPR 373 (NC) has held that when once matter has been fully and finally settled complaint cannot reagitate matter again before the Consumer Forum. Therefore we feel that complaint is not maintainable in view of settlement arrived at between the parties.
In the result, complaint is found not maintainable and the case is dismissed.
