1.       At the outset, Mr. Jha, learned counsel appearing for the National Insurance Company (R-2 &3) submitted that after disposal of F.A. No. 82/14 filed by the Insurance Company before this Commission on 28.7.2014, the entire decreetal amount was paid by the Insurance Company in the Executing Court by cheque dated 22.9.2014  for Rs. 3,39,000/- which was received by the complainant. He files photo copies of the cheque and the petition dated 23.9.2014 showing the payment and the receipt.

2.       Mr. Anupam Sanyal, learned counsel appearing for the appellant submitted that in that view of the matter nothing survives in this appeal.

3.       Accordingly this appeal stands disposed off, in view of the payment of the entire decreetal amount to the complainant.

4.       As prayed, let the statutory amount be returned to the appellant within six weeks.
