O R D E R

RAM SINGH CHAUDHARY, JUDICIAL MEMBER:

 

Revision Petition has been filed against the order dated 12.02.2019 passed by the learned District Consumer Disputes Redressal Forum, Rohtak vide which the Director PGIMER, Chandigarh is directed to constitute a board of doctors to establish the negligence/deficiency in service on the part of the O.Ps. in giving teeth implant treatment to the complainant Sh.Rajender.  Learned District Forum also directed to appear before the board on 07.03.2019 and shall provide all the necessary evidence and documents to the board and the board shall be submitted its report by 19.03.2019.

2.      The arguments has been advanced by Sh. Nilesh Bhardwaj,  the learned counsel for the revisionists at the time of motion hearing.  With their kind assistance the entire record of the revision petition has also been properly perused and examined.

3.      It appears that the order passed by the learned District Forum, Rohtak in a haste manner and without getting the evidence of parties, which is illegal and arbitrary.

4.      In the considered opinion of this Commission, no such order could be passed, which reflects upon the working of the senior Medical Officers in the rank of Director, Principal of the Dental College of Pt. B.D.Sharma University of Health Sciences, Rohtak.  Moreover, it appears that the order has been passed in such a casual manner that the Director of P.G.I.M.E.R, Chandigarh had been directed to constitute a board, where the present revisionist would appear and then to clarify about getting the illegal gratification.  The order passed by the learned District Forum, Rohtak is not legally sustainable.  Hence, impugned order dated 12.02.2019 is set aside and Revision Petition is allowed.
