One of the points raised by the petitioner in the complaint was that the District Forum at Patna did not have the jurisdiction as neither the cause of action nor a part of action had arisen in Patna. Counsel for the respondent, after taking instructions from the -2- respondent who is present, submits that the order of the District Forum as well as the State Commission be set aside and the District Consumer Disputes Redressal Forum, Patna be directed to transfer the complaint no.180/2003 filed before it to the competent court having jurisdiction to hear the complaint. In view of the statement made by the counsel for the respondent, the impugned orders are set aside and the District Consumer Disputes Redressal Forum, Patna is directed to transfer immediately the record of complaint no.810/2003 titled as Rajendra Narayan Dash V/s Chief Post Master General, Bihar Circle, Patna and Ors., to the District Consumer Disputes Redressal Forum, Khurda. This complaint was filed in the year 2003. We would request the Presiding Officer of the District Consumer Disputes Redressal Forum, Khurda to dispose of the complaint within six months of the receipt of the record.
-3- Parties through their counsel are directed to appear before the District Consumer Disputes Redressal Forum, Patna on 28.10.2010 to enable the District Forum, Patna to pass appropriate orders transferring the case to District Forum at Khurda. Revision petition stands disposed of in above terms.
