Case called out. Learned counsel for the appellant is present and has submitted that the respondent No. 1-complainant has accepted the offer made by the appellant for providing a fresh/new split A.C. of the same specification.
Learned counsel for the appellant has also submitted that the old A.C., which was in possession of the respondent No. 1-complainant has been returned back to the company and he has also filed a photocopy of the letter of settlement.
Vide order dated 25.05.2015, the respondent No.1 was directed to present in person before this Commission on the date fixed, but it appears to us that as the respondent No. 1-complainant has received the new split A.C. from the company, therefore, he does not seem to be interested in appearing before this Commission on the date fixed.
However, in the aforesaid circumstances, we disposed of the appeal finally in terms of the settlement arrived at between the parties.
The direction issued by the District Forum for payment of Rs. 50,000/- to be paid to the respondent No. 1-complainant as well as a sum of Rs. 1,00,000/- be deposited with the District Forum is hereby set aside in the light of settlement arrived at between the parties.
The appeal is, accordingly, finally disposed of.
