This application is for restoration of A.No.324/09 which is dismissed for default.

We heard Adv.Paunikar for the applicant. He has pointed out the defects and faults in the order passed by this commission dismissing the appeal in default. He has also pointed out the grounds for restoration of appeal. We do agree and appreciate the arguments advanced by Adv.Pavnikar for the applicnt. But when there is no jurisdiction to this commission to restore the appeal, this commission can not restore the appeal. It is sell settled law that U/s22 A of the Consumer protection act, only the National Commission has power to restore the appeal. Therefore, this application stands dismissed.

No order as to costs.
