ORDER

Shri Sudip Majumder- President-in-Charge.

            The record is put up today on the strength of one application filed by the complainant and stated that the notice was sent to the OP in the address given in the cause title but the said notice has been returned without service. Thereafter, complainant has collected the new address of the OP and as such it is necessary to amend the complaint in the following manner.

The complainant amendment sought for the description of OP in cause title the address

10 Clive Row, 2^nd FLR, Room. 6/7, Kolkata. 700001 will be deleted and in that place the following words and digits will be written “10, Radha Bazar Street, Kolkata. 700001.”

            The amendment petition filed by the complainant and same has been registered as M.A. Case being No. 64/2024. Record is now taken up for passing of order.

            Perused the petition. Considered. From the content of the petition it appears that the complainant intents to amend the address of the OP on the petition of complaint.

            In the instant case, this Commission is of view that if the prayer for amendment as made by the complainant would be allowed by this Commission that cannot change the nature and character of this case because it formal in nature.

Hence, the amendment petition being M.A Case being No. 64/2024 is considered and allowed on without contest and without cost.

            The complainant is also files an amended complaint today.

            Hence, it is accepted and be kept with the case record.

Complainant files requisites upon OP.

Issue summon/notice accordingly.

            B.C. to do the needful.

Thus the M.A. Case No. 64/2024 is disposed of.      

            Fix. 06/06/2024 for S/R, appearance and W/V by the OP.

 

Copy of this order be supplied to the parties each free of cost.
