This appeal has been preferred against the order dated

8.3.2016 of the District Consumer Forum, Bhilwara whereby partial order has been passed in favour of the complainant.

 

The contention of the complainant is that her husband remained hospitalized in Rajasthan Hospital,Ahmedabad from 16.2.2011 to 22.2.2011 for which reimbursement has been allowed to him as per the rates of SMS Hospital,Jaipur. He has further remained hospitalized at Ahmedabad from 18.8.2011 to 23.8.2011 and from 7.10.2011 to 18.10.2011 and has incurred expenditure but same has not been allowed by the Forum below inspite of fact that he has been referred by the Govt. Hospital,Bhilwara hence, his full claim should have been allowed.

 

Heard the learned counsel for the appellant and perused the impugned judgment.

 

The Forum below has rightly held that the husband of the complainant remained hospitalized from 16.2.2011 to 22.2.2011 in Rajasthan Hospital,Ahmedabad as there was emergency and doctors of the hospital has also certified the same but no such emergency was in existence on later occasions i.e. when the deceased remained hospitalized from

18.8.2011 to 23.8.2011 and 7.10.2011 to 18.10.2011 and the Forum below has rightly not allowed the claim for the same.

 

In view of the above there is no merit in this appeal and liable to be rejected.
