Order dated 07.02.2012 passed by the Rajasthan State Consumer Disputes Redressal Commission in appeal no. 135 / 2012 in under challenge in these proceedings. The appeal before the State Commission was filed by the petitioner herein against the order dated 15.07.2011 passed by the District Consumer Disputes Redressal Forum, Ajmer in complain no. 399 / 2010. The District Forum passed the order in favour of the complainant / petitioner, yet uncontended with the same, the petitioner filed the appeal after an undue delay of 163 days without explaining any reason which would amount to sufficient cause for exercising judicial discretion in condoning the said delay by the State Commission. The State Commission dismissed the application for condonation of delay and consequently the appeal. In our view, the order is fully justified on record and does not suffer from any illegality, material irregularity or much less any jurisdictional error which warrants interference by this Commission. Dismissed.
