Director,Department of Health and Family Welfare. filed a consumer case on 20 Feb 2017 against Rajarshi Motors Pvt. Ltd. in the StateCommission Consumer Court. The case no is CC/1/2017 and the judgment uploaded on 21 Feb 2017.
The instant petition is filed by the Director, Department of Health & Family Welfare and the Branch Officer (Transport) Department of Health & Family Welfare under section 12 of the Consumer Protection Act, 1986 for realization of money along with interest, cost and compensation as mentioned in the petition.
When the matter is taken up for admission of hearing, this Commission pointed out that section 12 of the Consumer Protection Act gives jurisdiction to the District Forum not to the State Commission for filing petition against any party for deficiency of service and compensation.
The Consumer Protection Act vested jurisdiction upon the State Commission for deciding an original complaints value of which is exceeds Rs.20 lacs, but does not exceed Rs.1 crore is under section 17.
At this stage, Mr. Kushal Deb, Ld. Advocate appearing for the complainants wants to withdraw the petition with a liberty to file a fresh petition in accordance with law.

The instant complaint petition is disposed of as withdrawn with a liberty to file appropriate application under appropriate provision, if so advised.
The office is directed to returned the statutory deposit of Rs.2,000/- deposited by the complainants to this Commission by Demand Draft to the complainants through its Ld. Advocate immediately by following the proper procedure.
