Rajan Trading Company, 71, Grain Market, Sector 26, Chandigarh, through its Proprietor.

Present:          Ms.Babita Bisht, Adv. for Sh.Jagdish Sharma, Advocate for Complainant.

                        Sh.Vaibhav Kaushik, Advocate for OP.

                                                            ORDER

1.                     This case has been taken up today in the Lok Adalat. Counsel for OP has made offer as per the statement given below:

“Statement of Sh.Vaibhav Kaushik, Advocate for OP.

 

That in compliance of the orders of the Hon’ble State Commission dated 16.2.2010, the OP deposited Rs.16,750/- with this Forum. Further, an amount of Rs.16,750/- was deposited with the Hon’ble State Commission at the time of filing the Appeal No.54 of 2010. The appeal has since been dismissed on 23.8.2010. I have no objection if the total amount of Rs.33,500/- (Rs.16,750/- + Rs.16750/-) is released to the complainant. The order dated 29.12.2009 passed by this Forum in CC No.1318 of 2009 stands complied with by the OP.” 

 

2.                     Counsel for the complainant has accepted the offer as per the following statement:-

“Statement of Ms.Babita Bisht, Adv. for Sh.Jagdish Sharma,Advocate for Complainant.

 

I have gone through the statement made by Sh.Vaibhav Kaushik, Advocate for OP and accepted it as correct. The amount of Rs.33,500/- (Rs.16,750/- + Rs.16750/-) may be released to the complainant”

 

 

3.                     The respective parties shall remain bound by their statements.

4.                     The sum of Rs.16,750/- already deposited by OP with this Forum in compliance of the orders of the Hon’ble State Commission dated 16.2.2010 be paid to the complainant. The office is directed to issue a cheque for the like amount in favour of the complainant. For the remaining amount of Rs.16,750/-, the complainant may make an application to the Hon’ble State Commission for the withdrawal of the said amount. The OP has already given no objection if the toal amount Rs.33,500/- (Rs.16,750/- + Rs.16,750/-) is released to the complainant. In view of the above, the execution application filed by the complainant stands disposed of as fully satisfied.

5.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
