.                  Mr. Saurabh Sharma, learned counsel for appellant has suffered a statement that the present appeal has become in-fructuous as the complainant-respondent has already deposited the balance due amount as per letter received from HSVP, Sonipat vide Memo No.11381 dated 10.12.2018 (Annexure-A, B & C). Accordingly, he may be permitted to withdraw the present appeal being in-fructuous. His statement in this regard recorded separately.

2.                In pursuance of the statement suffered by Mr. Saurabh Sharma, learned counsel for the appellant, present appeal stands dismissed as withdrawn being in-fructuous.

3.                A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.

4.                Application(s), pending, if any, stand disposed off accordingly in terms of this order.

5.                Statutory amount of Rs.25,000/- (Rs. Twenty Five thousand only) deposited at the time of filing of present appeal be refunded to the appellant against proper receipt, identification and as per rules.

6.                File be consigned to record room alongwith a copy of this order.
