ORDER

 

 

  1. On 27.07.2023, counsel for the appellant stated that a settlement stood arrived at between the parties and accordingly, he requested for a short adjournment for placing on record the settlement deed. On the adjourned date i.e. 25.08.2023, proxy counsel for the appellant stated that pursuant to the settlement arrived at between the parties, the memorandum of settlement has been executed. However, he sought a short adjournment so as to seek instructions from the appellant regarding disposal of the execution.
  2. On the previous date i.e. 22.09.2023, proxy counsel for the appellant once again confirmed the factum of settlement between the parties.
  3. Proxy counsel for the appellant has placed on record the memorandum of settlement dated 27.01.2023.
  4. In view of the settlement arrived at between the parties, proxy counsel for the appellant prays for withdrawing the appeal.
  5. In view of the above, the appeal is hereby dismissed as withdrawn.
  6. The statutory amount of Rs.25,000/- deposited by the appellant at the time of filing of the appeal be refunded in favour of the appellant against proper receipt and identification.
  7. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  8. A copy of this order be provided to all the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
  9. File be consigned to record room along with a copy of this order.
