                    Applicant is present in person.

                    Shri Rajeev Jain, learned counsel for the respondents.

                    Heard applicant/complainant and learned counsel for respondents on Transfer Application no.05/2019.        

                        Applicant/complainant has stated that he has filed a complaint before the District Consumer Disputes Redressal Forum, Ratlam in which one of the respondent is Divisional Railway Manager, Western Railway, Ratlam apart from four other respondents.  According to him the President of the District Forum, Ratlam is wife of Divisional Railway Manager, Western Railway, Ratlam and as such the case be transferred to other Forum.

                    On the other hand, learned counsel for respondents has argued that essentialy the complaint is against the Chief Medical Officer, Divisional Hospital, Western Railway, Ratlam

and as such the complaint which is at the final stage need not to be transferred.  He submits that transfer application is not on justifiable grounds.

                 Having considered the submissions made by the applicant/complainant and learned counsel for the respondents we are of the view that no case is made out for transfer of the case to other Forum merely on the ground that the President of the Forum is wife of one of the respondent who is a party in his official capacity and nothing of personal of his is involved in the matter.    

                    In the circumstances, the application is dismissed.
