Shri Lalit Gupta, learned counsel for complainants Dr. Sanjay Parashar and Shri Manoj Parashar. Shri Ajay Dubey, learned counsel with Shri Faiz Mohammad Khan, the opposite party no.3. None for the opposite party no.1 and 2 Railways. Both these appeals arise out of the order dated 04.03.2016 passed in C.C.No.177/2013 by the District Consumer Disputes Redressal Forum, Bhopal, hence taken up together. Learned counsel for parties submit that both parties have settled the dispute amicably out of court and compounded the matter as per terms of settlement that opposite party no.3 Faiz Mohammad Khan has paid Rs.16,000/- to complainant Dr. Sanjay Parashar through banker’s cheque no. 210378 dated 23.02.2017 of Bank of India, Professors Colony Bhopal in favor of Dr.Sanjay Parashar today. The opposite party no.3 Faiz Mohammad Khan has also agreed that -2- Rs.25,000/- deposited by him for appeal no. 1410/2016 in the District Forum be also given to complainant Dr. Sanjay Parashar, thus total amount of Rs.41,000/- would be received by the complainants towards final discharge of their claim. Shri Faiz Mohammad Khan is present before us, he has also admitted the settlement. Accordingly, Appeal no. 436/2016 filed by the complainants Dr. Sanjay Parashar and Manoj Parashar shall stand disposed of as withdrawn. Shri Faiz Mohammad Khan, opposite party no.3/appellant in Appeal no.1410/2016 withdraws this appeal. He submits that the amount of Rs.25,000/- deposited in the District Forum for his appeal be paid to respondent no.1 and 2 Dr Sanjay Parashar and Manoj Parashar. Accordingly, the Appeal no.1410/2016 is also disposed of as withdrawn. The amount of Rs.25,000/- deposited in the District Forum, Bhopal on 20.09.2016 shall be paid to respondent/complainant Dr. Sanjay Parashar. Accordingly, both appeals stand disposed of.
