Opposite party is present through his lawyer. Complainant is absent in this case since long. A notice has been served to the complainant for procuring his attendance which returned back by the postal department unserved with an endorsement that Addressee left without Information tracking report is also attached with the record.

Learned Lawyer of Opp has also informed this commission regarding the death of complainant by filing a petition dated 24/08/2022 along with death certificate of the complainant. No any legal heirs of complainant appeared before this commission to continue this case. Ite is confirm that complainant has died as because notice sent to the complainant also returned back to this commission without service.

Thus in the above mentioned facts and circumstance of this case this complaint case is dismissed due to non – prosecution. Keep the record in the record room.
