1. Pleadings of the complainant in brief.
The opposite party collected Rs. 41,920/- from the complainant on various occasions in the pretext of offering a job. All these transactions were UPI transactions. Since the opposite party has been asking for more money in one pretext or other she realized that she is being cheated and approached this Commission seeking a compensation of Rs. 1,00,000/-
2. Though the notice issued to the opposite party was served, they did not enter appearance, hence was set ex-parte.
3. The complainant filed proof affidavit and marked Ext. A1 to A15 as evidence. Ext. A1 to A12 are the screenshots of various payment made to the opposite party by the complainant. Ext. A11 to A13 are the payment confirmations, A14 is the first interview result, and A15 is the offer letter.
4. From the proof affidavit filed and documents marked from the side of the complainant it is evident that the opposite party collected Rs. 41,920/- by offering a job and collecting such a huge amount in the pretext of various charges is to be treated as unfair trade practice on the part of opposite party. The complainant having proven a prima-facie case, this Commission is left with no other option but to accept the pleadings of the complainant and pass orders accordingly.
5. As a prima-facie case is established by the complainant against the opposite party the complaint is allowed ordering the following reliefs
- The opposite party is directed to refund Rs. 41,920/- collected from the party along with interest @ 10% per annum from 30/09/2022 (being the date of 1st payment) till the date of payment.
- The opposite party is also directed to pay Rs. 50,000/- as compensation and
- Rs. 5,000/- as cost.
The opposite party shall comply with the directions in this order within 45 days of receipt of this order, failing which opposite party shall pay to the complainant Rs. 250/- per month or part thereof until the date of payment in full and final settlement of this order.
