<br /> 2. The opposite party appeared and filed written version, they have admitted that the complainant was the Secretary of the "Nethaji Drinking Water Project". The project was started with the contribution of the Peerumedu Development Society, Bisonvalley Grama Panchayath, the consumers of the project and the bank interest. After the completion of the work, the report and the account of the work was not produced before the committee by the comlainant. The members of the committee requested several times for producing the account of the works of the project. After on 9.05.2006 a committee was called by the Secretary, an account was released with an addition expense of Rs.7,318/- but the members were not ready to accept the account. Alleging corruption in making accounts by the Secretary, they requested for producing the original accounts of the expense of the work. The electricity connection of the project was disconnected due to non-payment of the electricity bill by the Secretary which was contributed by the members of the project. So the members organised a fresh committee and the opposite parties were selected as the responsible persons for the committee. Notice was given to the complainant to produce the original accounts of the expenses for the work, but the complainant did not response for the same and so the water connection of the complainant was disconnected on 12.12.2006. There is no negligence in the part of the opposite party. <br /> 3. The point for consideration is whether there was any deficiency in service on the part of the opposite parties, and if so, for what relief the complainant is entitled to ? <br /> <br /> 4. The evidence consists of the oral testimony of PW1 and Exts.P1 and P2 marked on the side of the complainant. There was no oral evidence from the part of the opposite party. The opposite party never appeared after filing the written version and was exparte at the time of producing evidence.<br /> <br /> 5. The POINT :- There is no dispute between the parties regarding the matter, the complainant is a consumer of the opposite party. The opposite party admitted that the complainant and the opposite parties are the members of the drinking water project started in Bisonvalley Village in the name and style 'Nethaji Drinking Water Project' is also admitted. The complainant was the Secretary of the said project. The said project was start to the contribution of the consumers(Members) of the project, Grama Panchayath, Bisonvalley and the Peerumedu Development Society. As per the written version, the opposite party admitted that they have disconnected drinking water connection of the complainant. Now the only dispute regarding the matter is whether the act of the opposite party by disconnecting the water connection of the complainant. The opposite party has got any right to do the same. Ext.P1(series) is the copy of the bill produced by the complainant for the electricty supply of the society 'Nethaji Drinking Water Project' from 25.04.2006 to 23.11.2006. Ext.P2 is the copy of the complaint given by the complainant before the Sub Inspector of Police, Rajakkadu. Against he disconnection of the water connection of the opposite parties,the complainant is regularly paying his electricity bill for the project without due from 25.04.2006 onwards. The opposite party never challenged the same. There is no conclusion for the opposite party that the complainant is not paying his own contribution for the regular functioning of the project. There is no complaint is made by appropriate forum or the authorities against the complainant by the opposite party alleging the corruption in the accounts of the work. If the opposite party as go such a contention or allegation, they can approach before appropriate legal authorities for their remedy. Disconnection of the water connection of the complainant who is doing the payment regularly for the same is a gross deficiency in the part of the opposite party. So we think it is fit to direct the opposite parties to reconnect the drinking water connection of the complainant. The complainant is also entitled to get the compensation of Rs.1,000/- for the mental agony caused to the complainant by disconnecting the water connection by the opposite party and Rs.500/- the cost of the petition.<br /> <br /> In the result, the petition allowed. The opposite party is directed to reconnect the water connection of the complainant within one week and give Rs.1,500/- to the complainant within one month of receipt of a copy of this order, failing which the outstanding amount shall carry 12% interest per annum from the date of default.<br /> <br /> <br /> Pronounced in the Open Forum on this the Ist day of July, 2008 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
