Final Order/Judgement.
The case is taken up for Admission Hearing. Heard the case from the Complt. The fact of this case is that the Complt. is a sole proprietor of Sikha Enterprise acting as supplier and distributor of different edible oils within the district f Paschim Medinipur. Complt. To improve his business applied for super distributor to the Company under the name and style of RAGAHAV IMPORT EXPORT PVT.LTD. After getting distributorship Complt’s. business runs huge financial transaction through Axis Bank.
From the Complaint Petition we observed that Complt. Runs commercial business which is not within the purview of the definition of ‘Consumer’ in CCOREDANCE OF Consumer Protection Act 2019.
Considering all we feel inclined to hold that the instant case has no jurisdiction to entertain the dispute, basing the subject matter of the complaint is a commercial business.
In the premises the petition of the complaint is not admitted and the same stands rejected.
Hence it is ,
ORDERED
That the case be and the same is not admitted and accordingly rejected.
Let a copy of this order be given to the complt. free of cost.
