We have heard learned counsel for the parties. -2- 2. By consent of learned counsel, we allow the appeal and set aside the impugned order and judgment rendered by the State Commission in Complaint Case No.C-19/2006 with the following directions: a. The complaint case shall be restored to its original number. The appellant shall appear before the State Commission and may file written reply/submissions. b. The parties are at liberty to file documents and written submissions, if any, as may be deemed proper. c. The State Commission shall decide the complaint case on merits after hearing both the sides and that the question pertaining entitlement of the respondents (complainants) for the benefit under the insurance policy shall be decided in accordance with law. 3. The parties shall appear before the State Commission on 16.08.2011 and may exchange the relevant documents and the pleadings as well as written submissions. The parties to bear their own costs of the present appeal.
