ORDER

By SRI.R.VIJAYAKUMAR, MEMBER. The complaint is filed for getting an order directing the opp.parties to pay the complainant Rs.2,25,000/- with interest at the rate of 9% and compensation of Rs.10,000/- and cost. The averments in the complaint can be briefly summarized as follows: The complainant deposited Rs.1,50,000/- to the 1st opp.parties bank, in which other opp.parties are partners. Opp.parties promised interest at the rate of 20% and issued a Term Deposit Certificate bearing No.KR/F.No.A-825. Interest at the rate of 20% paid till date 28.9.2004. Afterwards committed default in payment of interest. The complainant approached the bank several times for withdrawal of the entire amount and at last sent notices dated 5.4.2005 and 1.2.2007, but not replied,. Opp.parties are liable to pay the deposited amount Rs.1,50,000/- with 20% interest from 28.9.2004 till the date of filing the complaint. Hence the complaint. Opp.parties remained absent. Hence sets exparte. Complainant filed affidavit and exhibits are marked. The points that would arise for consideration are: 1. Whether there is any deficiency in service on the part of the opp.party 2. Compensation and cost. Points 1 and 2 As opp.party remained absent we are constrained to relay upon the evidence adduced by the complainant. The complainant could prove her case through complaint, affidavit and exhibits marked. The complaint was heard. We find that there is deficiency in service and unfair trade practice on the part of the opp.party. In the result the complaint is allowed. Opp.parties are directed to pay Rs.2,25.000/- along with an interest at the rate of 6% per annum and Rs.3,000/- as compensation and cost to the complainant. The order is to be complied with within one month from the date of receipt of this order. Dated this the 16th day of May, 2008.
