JUDGMENT

 

JUSTICE SHRI. K.R. UDAYABHANU:  PRESIDENT

 

The Revision petitioner is the complainant in CC.99/08 in the file of CDRF, Ernakulam.  The revision petition is filed over the order of the Forum setting aside the report of the Commissioner on the ground that the commissioner did not serve notice on the opposite parties.  On a perusal of the report of the commissioner we find that remitting the commission report will serve no purpose as the commissioner has reached certain final conclusions with respect to the stability of the building.  In the circumstances we find no interference in the order of the Forum is called for.  The Forum is directed to issue a fresh commission after receiving panel of experts from both sides.  The Forum is also directed to issue such specific directions to the commissioner to issue notice to the counsel appearing for both sides.  The counsel will see to it that the notice of the commissioner is communicated to the parties.  The revision petition is disposed of accordingly.

Office will forward a copy of this order to the Forum.
