Complainant/respondent was allotted a plot by the petitioner. There was a high-tension wire running over the allotted plot. Respondent applied for removal of the high-tension wire. He deposited the requisite amount for removing the high-tension wire. As no action was taken, respondent filed a Complaint before the District Forum.

District Forum allowed the Complaint and directed the petitioner to remove the high-tension wire for which the amount had already been deposited by the respondent.

 

On an Appeal filed by the petitioner, State Commission modified the Order passed by the District Forum and directed the petitioner to remove the high-tension wire on deposit of requisite amount, if any, as per the prevalent rates. Direction has also been issued to M.P. State Electricity Board to remove the high-tension wire within 4 months from the date of passing of the Order.

 

The Order passed by the State Commission is correct in equity as well as in law. No ground for interference is made out. Dismissed.
