         This execution petition has been filed by the DH for non compliance of the order dated 23.10.2015 passed by this forum in CC No. 203/2015. Since JD has filed an appeal before the Hon’ble State Commission numbered as FA  No. 102/2016 against the order of this forum mentioned above , the Hon’ble State Commission vide its order dated  24.05.2016 accepted the appeal and set aside the impunged order subject to payment of cost of Rs 5000/- and remanded back the matter to the district forum for its decision on merits. Copy of the order dated 24.05.2016 in F.A. No. 102/2016 is placed on the file. Cost of Rs 5000/- already paid to DH. In view of the above facts the execution petition does not survive and is hereby dismissed. File be consigned to record room.
