1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The first opposite party appeared in person. Notice issued to the second opposite party was served and not entered appearance and hence on 11.10.2019, second opposite party was declared exparte. Notice issued to the third opposite party was not returned and hence the complainant was directed to take steps against the third opposite party. Inspite of giving sufficient opportunities the complainant failed to take steps against third opposite party. As the complainant was continuously absent, this Commission issued notice to the complainant to appear before this Commission today to further proceed with this complaint. When the case came up for consideration today it is noticed that the notice issued to the complainant was returned with endorsement not known. The notice was issued by this Commission in the address mentioned by the complainant in the complaint. As the complainant has not taken any steps against the third opposite party and from the continuous absence of the complainant, we find that the complainant is not interested to further proceed with this complaint.
In the result, the complaint is dismissed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
