          The gist of the complaint is that the complainant joined in the chitty run by  opposite parties Nos 1 to 3 on 6/3/06.  The total chitty  amount on maturity was Rs.100000/-.  The monthly subscription payable was Rs.2000/-.  Complainant paid 13 monthly instalments.  The chitty subscription  was paid up to 25/7/07.  Thereafter he approached opposite parties and asked to  pay the chit amount  of Rs.100000/-.  But the opposite parties  delayed the demand and later did not paid pay the amount.  Hence alleging deficiency in service on the part of the opposite parties  this complaint is filed.

2.    Notice issued to opposite parties by  registered post with acknowledgment due.  But notice to Opposite parties  Nos.1  and 3 returned undelivered with the endorsement left.  Opposite party No.2 though received notice and appeared through counsel later not turned up to file version.  Hence it appears that he has no  explanation to offer to the  averments made by the complainant in the complaint.  Since the notice to opposite parties Nos.1 & 3 returned as left, substituted service through publication in local daily was ordered.  Even after publication of notice opposite  parties 1&3 remained absent  and set exparte.

3.    Complainant filed  affidavit  reiterating  what is stated in the complaint.  His chitty pass book marked as Ext.A1  .  From the entries made in Ext.A1 it is revealed that the complainant has remitted  a total  sum of Rs.26,000/- in the chitty.  The non completion of chitty and the non payment of  chitty amount on demand to a  subscriber is a deficiency in service on the part of  opposite  parties.  Therefore opposite parties are liable to compensate the complainant for the loss sustained to him.

       Hence the complaint is allowed and opposite parties Nos.1 to 3 are jointly and severally directed to pay Rs.26,000/- with interest @9% per annum from the date of complaint till payment along with a cost of Rs.2500/ -   to the complainant within 30 days from the date of receipt of copy of order.
