ORDER SRI.K.T.SIDHIQ: PRESIDENT: The grievance of the complainant in brief is that the opposite parties 1 to 3 appropriated her chitty instalments paid in the chitty conducted by opposite parties. According to him he joined in the chitty on 06/03/06. The total chitty amount on maturity was Rs.1,05,000/-. Complainant remitted 12 monthly instalments of Rs.5,000/- totaling Rs.60,000/- till 6/2/07. But opposite parties neither completed the chitty nor paid the chitty instalments remitted by hundred of chittalans including complainant. Hence the complaint praying for an order of payment of Rs.105,000/- being the matured chit amount and a sum of Rs.5,000/- towards the mental agony suffered by the complainant with costs. 2. Notice to all opposite parties were issued by registered post with acknowledgment due. Though notice to opposite party No.2 served and represented through a counsel but no version is filed. Notice to opposite parties 1 & 3 returned as unserved with endorsement of the postal authorities as left. Hence notice by publication in the local daily was allowed. Evenafter publication of notice opposite parties 1 & 3 remained absent. Hence all the opposite parties were set exparte. 3. Complainant filed affidavit in support of her claim reiterating that is stated in the complaint. Ext A1 the chitty passbook marked. Heard the counsel for the complainant. Claim of the complainant proved. 4. The non completion of chitty and the appropriation of chitty instalments are deficiency in services on the part of opposite parties. It became more grave when the chitty run by the opposite parties do not have the required license from the authorities to conduct the same. This is nothing but an unscrupulous exploitation of consumers Therefore the complaint is allowed and the opposite parties 1 to 3 are jointly and severally directed to refund Rs.60,000/- with interest @9% per annum from the date of complaint till payment along with a cost of Rs.2500/-.
