Both the fora below have found that the petitioner had failed to establish that the respondent was stealing the electricity.  Person who prepared the Mahazar or the persons who had witnessed the Mahazar were not examined to prove the document.  Petitioner had also filed an FIR which was never pursued.  The finding recorded is a finding of fact.

          Otherwise also, we are of the opinion that production of the document is one thing and proof of the document is another.

Petitioner after producing the document failed to prove it by producing either the scribe or the persons who had witnessed the execution of document.  We do not find any infirmity in the order passed by the State Commission.  Dismissed.
