In course of hearing ld. Advocate for the applicant side pointed out that there is urgency for filing interrogatories and over this issue ld. Lawyer of applicant side also referred the provisions of Section 38 of C.P. Act.
The applicant side also has filed one BNA.
On the other hand, ld. Advocate for the op/ complainant raised verbal objection and adopting the plea that for the purpose of delaying the disposal of this case this delaying tactics has been adopted.
However, for the interest of proper and complete adjudication of this case and in view of the provisions of Section 38 of the Consumer Protection Act, the op is given liberty to file interrogatories against the evidence on affidavit filed by the complainant.
Fix 6.2.2023 for filing interrogatories in the C.C. case no. 74 of 2021.
In light of the observation made above this R.A. case is allowed on contest and disposed of.
