This is the second call. None present for the petitioner. On 16.11.2018 it was directed that notice be issued to the respondent. Inspite of repeated directions, notice has not been served on the respondent till date. On the previous date, i.e. on 16.09.2019, the petitioner was inter alia directed to also effect ‘dasti’ service of notice on the respondent. However, as reported by the Registry, ‘dasti’ notice has not even been collected. We note that the District Forum vide its Order dated 03.07.2015 had allowed the complaint on contest. The State Commission vide its Order dated 09.08.2018 had dismissed the appeal for want of prosecution. The instant revision petition has been filed against the said Order dated 09.08.2018 of the State Commission. Invoking the revisional jurisdiction of this Commission has concomitant responsibility of professional conduct of its case. Professional conduct of its case by the revision petitioner is patently lacking. For not being present on successive dates, the revision petition is dismissed for want of prosecution. Needless to add, the interim protection provided vide this Commission’s Order dated 16.11.2018 does not survive. The District Forum shall undertake execution of its Order dated 03.07.2015 as per the law. Let a copy each of this Order be sent to the District Forum and to the respondent / complainant by the Registry within ten days. |
