                Sh.Deepinder Singh Adv.counsel for the complainant got recorded his statement that duet to certain technical defects, he withdrew the present complaint with permission to file a fresh complaint at appropriate Forum/court on the same cause of action before the appropriate court/Forum after removing the technical defects. In view of the above statement, present complaint is ordered to be dismissed as withdrawn. Complainant is at liberty to file a fresh complaint on the same cause of action after removing the technical defects.

          That in compliance of the order of this Hon’ble Forum, the sample of the cake has been seized and sealed and was kept in the custody. Now the complainant has withdrawn the complaint. The said sample was directed to open in the Forum and it was found to be unworthy of human consumption and was infected with fungus and foul smell was emanating from it. As it was already mentioned in the previous order the said sample is of perishable nature. It is thereby directed to the Naib Court of this Forum to destroy the same. Ordered accordingly. File be consigned to the record room.
