| Final Order / Judgement | Order No.2 Ld. Advocate for the complainants is present. Ld. Advocate for the petitioner ‘Kyal Developers Pvt. Ltd., a company incorporated under the provisions of the Companies Act, 1956 having its registered office at 122/1R, S.N. Majumdar Sarani, Police Station – Tollygunge, Kolkata – 700 026’ is present. Perused and considered the Misc. Application dated 21/09/2023 filed by the petitioner above named. Ld. Advocate for the petitioner submits that the opposite party nos.4 got amalgamated with the petitioner Kyal Developers Pvt. Ltd., a company incorporated under the provisions of the Companies Act,1956, having its registered office at 122/1R, S.N. Majumdar Sarani, Police Station-Tollygunge, Kolkata – 700 026 by an order dated 07/05/2008 by the Hon’ble Justice Nadira Patherya in Company Petition No.191 of 2008. Ld. Advocate for the complainants raised no objection and admits the submission of the petitioner. Therefore, we are of the opinion that Kyal Developers Pvt. Ltd. be incorporated as opposite party no.6 in the complaint case No. CC/324/2022. So, the Misc. Application is allowed on consent but without any cost. Thus, the Misc. Application is disposed of. | |
