ORDER

By Smt. Padmini Sudheesh, President The petitioner had deposited Rs.50,000/- vide receipt No.1775 on 23/1/01 and Rs. 50,000/- vide receipt No.1796 on 4/4/01 in the respondent institution. The 1st respondent is the Managing Trustee and 2nd respondent is the Accounts Manager of the respondent institution. The respondent assured the petitioner that they will return the amount when it is demanded with 12% interest. The petitioner paid Rs.1,00,000/- in total. The deposit period was for 36 months. The respondent institution was closed on May 2003. The petitioner several times demanded for the deposited amount. But the respondent never returned that amount. The respondents had given Rs.1000/- on 20/10/04. Balance not returned. Hence the petition. The respondents called absent and set exparte. 2. To prove the case of the petitioner he has filed an affidavit and the documents produced by him are marked as Exhibits P1 and P2. 3. Heard the Counsel. 4. According to the petitioner he is entitled to get back the amount of Rs.1,00,000/- with 12% interest from the date of deposit. He also claims for compensation and costs. There is no counter evidence to the evidence of the petitioner. 5.So the petition is allowed and the respondents are directed to return the amount of Rs.50,000/- (Rupees Fifty Thousand only) with 12% interest from 23/1/01 and Rs.50,000/- (Rupees Fifty Thousand only) with 12% interest from 4/4/01 till realization. He is also entitled for Rs.1,500/- towards costs. Comply the order within two months. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open Forum this the 12th day of August 2008.
