            The complainant’s case is as follows. The complainant deposited Rs.50,000/- on 19.2.2000 vide receipt No.1601; Rs.50,000/- on 21.2.2000 vide receipt No.1602 and Rs.38,000/- on 25.6.2001 vide receipt No.2716. The total amount deposited is Rs.1,38,000/-. At the time of deposit it was assured that the respondent will return the amount at any time on request with interest at the rate of 12%. Subsequently the respondent trust was closed and the amount was not returned. Hence the complaint.
 
            2. The first respondent is called absent and set exparte. A statement filed by the complainant to the effect that no relief is sought against the 2nd respondent.
            3. The complainant filed affidavit and three documents to prove his case.
The documents are marked as Exts. P1 to P3.
 
            4. According to the complainant, the amount deposited by him with the respondent trust is not returned so far even if the trust was closed. The deposits were made on 19.2.2000, 21.2.2000 and 25.6.2001. There is no maturity date stated in the Exts. P1 to P3 receipts. It is stated in the complaint that he has obtained interest on 17.1.03 and 16.10.04 for Rs.2000/-. The principal amount and balance interest not received so far. So this complaint is filed to get back the amount. There is no evidence to the contrary.
 
            5. In the result, the complaint is allowed and the first respondent is directed to return the Exts. P1 to P3 amount with interest at the rate of 12% per annum from the date of deposit till realization with costs Rs.500/- (Rupees five hundred only) within two months. The interest amount accepted by the complainant is to be reduced from the above amount.
