ORDER

By Smt. Padmini Sudheesh, President The first respondent is the Managing Trustee of Punnyabhumi Daily. On 3/1/00 petitioners had deposited Rs.1,00,000/- in the respondent firm as per receipt No.1360. At the time of deposit it was assured that the amount will return with 12% interest on demand. The firm was closed on 2003 May. The amount not returned even after repeated demands. On 1/1/03 and 16/12/04 Rs.500/- was received as interest. But the principal amount and interest not returned so far. Hence this complaint. 2.1st respondent has accepted the notice from the Forum. The notice of 2nd respondent returned as abolished. Hence paper publication was ordered and set exparte after due procedure. Both respondents are exparte. 3. To prove the case petitioners has filed affidavit and one document which is marked as Ext. P1. According to the petitioners they are entitled for the deposited amount, cost and compensation. 4. There is no counter evidence. 5. In the result complaint is allowed and the respondents are directed to return the Exhibit P1 amount with interest at the rate of 12% per annum from the date of deposit till realization. Further directed to pay Rs.1000/-(Rupees One thousand only) as cost. Comply the order within two months. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open Forum this the 29th day of August 2008.
