By Smt. Padmini Sudheesh, President: The first complainant is the son and the 2nd complainant is the mother of first complainant. They have deposited Rs.1,50,000/- with the respondent trust by receipt Nos.1367 and 1381. The first complainant deposited Rs.1,15,000/- and 2nd complainant deposited Rs.35,000/- and the total amount deposited is Rs.1,50,000/-. At the time of deposit it was assured that the respondent will return the amount at any time on request with interest at the rate of 12%. Subsequently the respondent trust was closed and the amount was not returned. Hence the complaint. 2. The first respondent is called absent and set exparte. A statement filed by the complainant to the effect that no relief is sought against the 2nd respondent. 3. The complainants filed affidavit and two documents to prove their case. The documents are marked as Exts. P1 and P2. 4. According to the complainants, the amount deposited by them with the respondent trust is not returned so far even if the trust was closed. The deposits were made on 31.1.2000 and 15.2.2000. There is no maturity date stated in the Exts. P1 and P2 receipts. It is stated in the complaint that they have obtained interest on 15.12.2002 and 15.11.2004 of Rs.2000/-. The principal amount and balance interest not received so far. So this complaint is filed to get back the amount. There is no evidence to the contrary. 5. In the result, the complaint is allowed and the first respondent is directed to return the Exts. P1 and P2 amount with interest at the rate of 12% per annum from the date of deposit till realization with costs Rs.500/- (Rupees five hundred only) within two months. The interest amount accepted by the complainants is to be reduced from the above amount.
