By Smt. Padmini Sudheesh, President: The complaint is filed for realisation of deposited amount with interest. The case of complainant is that he had deposited Rs.50,000/- as per receipt No.11 on 20.3.2001 in the respondent trust. On receiving the amount the respondents agreed to pay back Rs.77,500/- including 11% interest on 8.3.2006. But no amount has been returned. Meanwhile the respondent firm was closed due to improper functioning and misappropriation of money by the respondents. Even though complainant demanded to return the amount with interest many times nothing was paid. Hence this complaint. 2. The respondents are absent and declared exparte. 3 In order to prove the case the complainant filed affidavit and produced the deposit receipt which is marked as Ext. P1. 4. The definite case of the complainant is that on believing the respondents words he had deposited Rs.50,000/- on 20.3.2001. It was agreed to return the amount with 11% interest and he is entitled to get back Rs.50,000/- with interest at the rate of 11% interest. The Ext. P1 receipt proves that Rs.50,000/- was deposited on 20.3.01 and the rate of interest promised was 11%. 5. There is no evidence to the contrary. 6. In the result, complaint is allowed and the respondents are directed to return an amount of Rs.77,500/- with interest at the rate of 11% per annum from 8.3.06 till realisation with costs Rs.1000/- (Rupees one thousand only) to the complainant within two months.
