None present for the DH. The D.H. has expired and the appeal filed by him before the National Commission, being F.A. No. 176/07, has been dismissed as abated by order dated 12/09/2011, and, it appears that no steps have been taken to set aside the said abatement.

Before this Commission, no steps have been taken to bring on record the legal representative of the DH. However, on 17/12/2012, Ms. Kalindi Doshi, the daughter of the D.H. remained present before this Commission and collected the payment made by the J.D. towards compensation and costs, as per the order of this Commission dated 7/11/2006. The said daughter of the deceased DH thereafter did not appear before this Commission on 1/04/13. The statement made on behalf of both the parties on 17/12/2013 to the effect that the first appeal was still pending, does not appear to be correct as the appeal is already disposed off as abated, by order of the National Commission dated 12/09/2011. Since the said Kalindi Doshi has not taken any steps to bring on record the legal representatives of the deceased DH, nor has pursued the execution as regards the interest to be paid, the execution application shall stand dismissed for non prosecution.
