Today, the case is fixed for preliminary hearing, but the learned counsel for the complainant has made a statement recorded separately that due to some technical defect in the present complaint, he withdraws the same with liberty to file a fresh complaint on the same cause of action.

In view of the aforesaid statement of learned counsel for the complainant, the present complaint is dismissed as withdrawn.  However, permission is granted to the complainant to file a fresh complaint on the same cause of action after removing technical defect. Original documents, if any, be returned, as requested, after retaining photostat copies thereof on record.. File be consigned to the record.
