1.             Smt. Bashira, complainant (referred to as complainant in short) has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that the connection number L36RP140083H was running in the name of her late husband, Shri Bashir Khan, who died in the year 2007 and since then the complainant has been using the connection in question and paying the bills regularly to the OPs.  Now, the case of the complainant is that she applied on 30.1.2017 for change of electricity connection in her name and also deposited Rs.50/- as meter change fee and further provided the certificate of caste and disability certificate to provide the connection and to change the tariff as given by the Govt being the BPL connection and handicapped widow lady. Further case of the complainant is that she also deposited an amount of Rs.22,160/- on account of electricity bills for the period from January 2017 to November 2017, but the said benefit was not given to the complainant nor the connection was changed in her name.  Thus, alleging deficiency in service on the part of the OPs, the complainant has prayed that the Ops be directed to change the name of above said electricity connection in the name of the complainant and further to change the tariff as per the policy of the Govt. and further to pay compensation and litigation expenses.

 

2.             In reply of the complaint, legal objections are taken up on the grounds that the complaint is not maintainable, that the complainant has not come to the Forum with clean hands and that the complainant has no cause of action to file the present complaint. On merits, it is admitted that the connection is running in the name of Bashir Khan and further admitted that the complainant applied for change of the electricity connection in her name on 30.1.2017. It is further stated that the change of the name of the connection in the name of the complainant was effected in 1/2017, but it is stated that the complainant never applied for any such relief regarding rebate given to backward classes, as such, the complainant cannot claim anything from the OPs.  Thus, alleging no deficiency in service on the part of the Ops, the Ops have prayed for dismissal of the complaint with special costs.

 

3.             The learned counsel for the complainant has produced Ex.C-1 to Ex.C-14 affidavit and copies of bills and documents and closed evidence. On the other hand, the learned counsel for the Ops has produced Ex.OP-1 to Ex.OP-12 copies of documents and affidavit and closed evidence.

 

 

4.             We have very carefully perused the pleadings of the parties and heard the arguments of the learned counsel for the parties. In our opinion, the complaint merits dismissal, for these reasons.

 

 

5.             At the outset, it is an admitted fact between the complainant and the OPs that the electricity connection in question was running in the name of Bashir Khan and after the death of Bashir Khan, the complainant on 30.1.2017 applied for change of name of the connection, which as per the contention of the Ops has been effected in the month of 1/2017.  Now, the learned counsel for the complainant has sought relief for change of connection in her name and has further sought concessions/benefits provided to the handicapped widow lady as well as to the other backward classes as per the policy of the Government.  But, the learned counsel for the Ops has contended vehemently that the complainant never applied for such benefits, as such, she is not entitled to challenge/sought these relief by filing the present complaint. Since it is on record that the connection in question has been changed in the name of the complainant, we feel that at this stage the complainant has no case made out for any deficiency in service on the part of the OPs. 

 

 

6.             In view of our above discussion, we dismiss the complaint of the complainant. However, the parties are left to bear their own costs. A copy of this order be supplied to the parties free of cost.  File be consigned to records.
