ORDER

Delay of 141 days in filing the revision petition is condoned in view of the Medical Certificate.

Petitioner was having two electric connections in the same premises; one in the name of his son and the other in his name.  One meter was lying dead.  Petitioner was running Non-Resident Supply (NRS) on S.P. connection.  The authorities after inspection ordered that the petitioner be charged with commercial rates and issued a bill for Rs.21,468/-.  Petitioner filed complaint before the District Forum.

-2-

District Forum allowed the complaint and directed the respondent to refund the sum of Rs.22,337/- along with interest                @ 9% p.a. to the complainant.

Respondent filed the appeal before the State Commission.  The State Commission reversed the order of the District Forum and directed the respondent to charge for six months prior to the date of inspection.

On perusal of the order of the State Commission, we do not find any substance in this revision petition.  The State Commission has taken into consideration the entire evidence.  Petitioner was having two electric connections.  One of them was lying dead.  Petitioner was drawing electricity for ‘commercial purposes’ from the S.P. connection and accordingly, has been ordered to pay the commercial charges for the same as he was using the SP connection to run Non-Resident Supply (NRS).  No merits.  Dismissed.
