ORDER

PER SANJEEV BATRA, PRESIDENT

1.                The complainant a domestic electric connection holder and retiree from the Department of OPs has filed the present complaint alleging bias and ill-will against the officials of OPs which lead to disconnection of electricity supply of the house of the complainant on 23.03.2021. According to the complainant, he sought information through RTI Act from the OPs for cutting the electricity wires approaching to his electricity meter vide applications dated 24.03.2021, 30.03.2021, 19.05.2021, 19.06.2021, 16.09.2021, 10.11.2021, 18.02.2022, 09.05.2022, 21.06.2022, 10.08.2022 and 03.10.2022. The complainant has further claimed that act and conduct of the OPs has caused mental tension, harassment and financial loss to the complainant. Therefore, by invoking the jurisdiction of this Commission through the present complaint, the complainant has prayed for issuance of directions to the OPs to pay Rs.2 lacs as compensation/damages on account of deficiency in service and Rs.20,000/- as legal expenses. The complaint is supported with affidavit of complainant along with the annexed documents. 

2.                We have heard the counsel for the complainant on the point of admissibility of the complaint and gone through the record.

3.                Counsel for the complainant has reiterated the version of the complaint in his arguments and further prayed for admissibility of the complaint at the preliminary stage.

3.                Perusal of letters Ex.C6 dated 12.06.2021 and Ex.C7 dated 06.09.2021 which are addressed to the complainant by the officials of OPs wherein it has been specifically mentioned that no order to disconnect the electric meter was made by the official of the OPs. Rather, on receipt of the complaint, electric supply to the house of the complainant was found to be disrupted on account of loose wires which was restored immediately.

4.                     Section 2(11) of the Consumer Protection Act, 2019 defines the words ‘Deficiency in Service’ which provides as under:-

Any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service and includes

(a)Any act of negligence or omission or commission by such person to the consumer and

(b)Deliberate withholding of relevant information by such person to the consumer.”

5.                The contents of the complaint are in contradictions with the documents annexed with the complaint by the complainant. Further, the grievance lodged by the complainant was promptly redressed. As such, there is no case of deficiency in service on the part of the OPs is made out and no consumer dispute is found to be existed between the complainant and the OPs.

6.                Consequently, we do not inclined to proceed with the present complaint and hence the same is hereby dismissed summarily at the admission stage itself. Copies of order be supplied to the complainant free of costs as per rules. File be indexed and consigned to record room, but after registering the same.
