Learned counsel appearing for the petitioner submits that in view of the decision of the Hon’ble Supreme Court in U.P. Power Corporation Ltd. & ors. Vs. Anis Ahmad – (2013)8 SCC 491, the petitioner may be permitted to withdraw the Revision Petition with liberty to take recourse to any other appropriate remedy as may be available to him in accordance with law.

Accordingly, the Revision Petition is dismissed as withdrawn with liberty as prayed.  Needless to add that if the petitioner take recourse to any other remedy except before a consumer forum, his application for condonation of delay in filing the case will be considered keeping in view the observations of the Hon’ble Supreme Court in Laxmi Engineering Works Vs. PSG Industrial Institute – 1995(3)SCC 583.
