ORDER

In this case notice limited to the imposition of the cost of
Rs. 5,000/- only had been issued.

          Heard the learned counsel for the petitioner and the counsel for the respondent-Punjab State Electricity Board.  Learned counsel for the respondent-Electricity Board submits that for the connivance of the staff of the Electricity Board with the petitioner-complainant, they have already charge-sheeted their employees.  However he contends that the complainant had filed a false affidavit which has been taken cognizance by the State Commission for which the cost of Rs. 5,000/- has been imposed.  Considering the gravity of misdemeanor, this cost cannot be said to be excessive.   He submits that there is no justification for any remission / interference by this Commission.  Counsel for the petitioner complainant however, submits that the complainant being an illiterate poor farmer, the cost is a burden specially when the opposite parties admit that their staff was behind the alleged irregularity.

Arguments advanced by the parties’ counsel have been considered.  In this case, the District Forum had passed an order in favour of the petitioner/complainant which was reversed on an appeal, by the State Commission. Further considering that the petitioner/complainant is a poor farmer, while maintaining the order passed by the State Commission, the imposition of the said cost of
Rs. 5,000/- is waived.

          The Revision Petition is disposed of in these terms.
